Tom A. Bingham

Tom has a broad depth of experience in corporate and individual business transactions, which he currently applies to the firm’s real estate practice. Tom also handles commercial litigation and probate matters for the firm as a well as criminal defense matters. Before joining Davis, Bingham, Hudson & Buckner, P.C., Tom concentrated in commercial litigation with substantial concentration in real estate and land title insurance litigation law in metro Atlanta where he practiced at Neel and Robinson, and at Troutman Sanders, one of the Southeast’s largest law firms.
Tom’s business litigation experience includes lead counsel at trials, hearings, depositions, and mediations. Tom has represented major pharmaceutical companies in defense of mass tort claims, insurance carriers in defense of tort and breach of contract claims, and a major accounting firm in defense of accounting malpractice and fraud claims. Tom has also served as lead counsel in numerous cases involving commercial litigation and trust and estates matters. Tom has appeared in many courts including the Alabama Court of Civil Appeals, Georgia Court of Appeals, Georgia Supreme Court, and the Eleventh Circuit Court of Appeals.
Prior to his decision to become a lawyer, Tom worked in secured finance for IBM where he managed a portfolio of information technology reseller accounts across the Northeastern United States including one of IBM’s largest business partners. Tom also performed financial analysis for IBM for the purpose of making secured lending decisions, and managed the negotiation, liquidation and collection of default accounts.
Tom received his undergraduate degree in Business Administration from Auburn University, where he served as Student Body President. While at the University of Alabama School of Law, Tom served as articles editor and on the editorial board of the Alabama Law Review.
Tom is married to the former Amy George. Tom and Amy met while they were students at Auburn and then married in 2000. Tom and Amy have a son, Patrick, and a daughter, Mattie. The Bingham’s are members of Auburn United Methodist Church.
Tom’s roots in East Alabama run deep. Tom is a part of the third generation of his family to attend Auburn University and both of his parents are Auburn alumni. The family of Tom’s paternal grandmother was originally from Russell County and his maternal grandfather graduated from Auburn High School in 1949.
While a student at Auburn University, Tom served as SGA President and was a member of Alpha Tau Omega fraternity. Tom was also a member of Omicron Delta Kappa, Mortar Board, and the Spade honorary.
Community service is important to Tom and he has been recognized for his pro bono work several times including a special commendation from the State Bar of Georgia in 2007. Additionally, Troutman Sanders honored him in 2003 and 2004 for his pro bono work on behalf of the Eviction Defense Program for Atlanta Legal Aid.
Currently, Tom serves as the public defender in the Auburn Municipal Court. Tom is also a member of the Kiwanis Club of Auburn.
